Article 2: Acceptance of the general terms of sale The Buyer must, prior to validating their order for Spare Parts, demonstrate their knowledge and acceptance of the General Terms of Sale - online by checking the "I approve and have read the General Terms of Sale" icon and then clicking the "Confirm Order" icon displayed on the screen. Any order for Spare Parts by the Buyer implies the full and unconditional adherence of the Buyer to the General Terms of Sale, excluding any other document such as brochures, catalogs, commercial proposals issued by Surplus Autos. The General Terms of Sale come into effect at the time of the Buyer's order validation and are concluded for the duration necessary for the supply of the Spare Parts ordered by the Buyer. These General Terms of Sale prevail over all general or specific purchasing conditions, except for express and formal derogation from Surplus Autos. Surplus Autos reserves the right to modify the General Terms of Sale at any time.

In this case, the applicable General Terms of Sale will be those in effect at the date of the Buyer's order. Article 3: General Warranty Conditions In accordance with articles 1641 and following of the Civil Code, Surplus Autos guarantees the Buyer against hidden defects of the Spare parts sold in addition to the contractual warranty of twelve (12) months from the date of purchase indicated on the invoice or delivery note.

The application of this warranty is subject to the condition that the assembly of the Spare Parts by the Buyer has been carried out in accordance with the rules of the art and in compliance with the recommendations and standards of the manufacturers. Under no circumstances can Surplus Autos be held responsible and assume any financial coverage for installation and removal costs, labor, accessories, supplements, shipping, breakdown, towing, immobilization, and vehicle rental.

Any modification of the Spare Parts (incorrect assembly, or lack of adjustment) will result in the exclusion of any warranty. As far as possible subject to its availability, within the framework of the warranty, Surplus Autos undertakes to exchange the said part. Otherwise, Surplus Autos will refund the Spare part to the Buyer. Article 4: Specific Warranty Conditions for certain Spare Parts In accordance with what is indicated above in Article 2, the Buyer must follow the following recommendations in order to be able to request the activation of the warranty following the purchase of the Spare Parts.

3.1 For engines: the warranty applies only to the bare engine. Peripheral parts are provided as a gift (so they are not guaranteed). All non-invoiced ancillary parts are therefore not guaranteed. Startup instructions are provided with the engine(s) but we still specify that before installation, it will be imperative to: - Place a new oil cartridge, oil filter and fuel. Do not use those supplied with the delivered engine and especially not those from your old machinery.

Spark plugs and/or glow plugs must also be replaced with new ones as well as coolant and oil. Have the timing belt or distribution kit changed according to the condition (belt and pulleys) as well as that of the alternator and water pump, by your mechanic, a damaged belt can seriously damage your mechanism. Before the first start-up, prime the oil pump by operating the starter for a long time (during this operation, the coil wire will be disconnected or the engine stop control in position for diesel engines). Do not rev the engine at startup, let it idle for a few minutes. All engines must now be programmed as well as the injectors, which is why we require that they be installed by an authorized mechanic and in possession of the appropriate equipment to perform the programming.

The 12-month warranty from the date of purchase or delivery note of said engine will only be granted if the engine has been installed by an authorized mechanic and the installation invoice may be requested from the Buyer. Without an installation invoice or installed by an unauthorized mechanic, the warranty will be denied. Any failure to comply with the above installation instructions would cancel the warranty from Surplus Autos and any anomaly at the cylinder head gasket level must be reported within 14 days of the engine purchase.

After this period, no claim can be recorded. The warranty will only apply if the oil consumption exceeds that defined by the manufacturer. 3.2 For gearboxes, transfer cases, and rear axles: non-invoiced peripheral parts are therefore not guaranteed.

Some accessories must be systematically replaced with new ones, such as transmission output seal and oil of a quality recommended by the manufacturer. 3.3 For transmissions: transmission boots are not guaranteed. 3.4 For alternators and starters: before installation, the buyer must check the electrical circuits.

3.5 For injection pumps: the peripheral parts are provided as a gift (so they are not guaranteed). Before installation, the Buyer must check the fuel circuits. 3.6 For injectors: our injectors come from engines that have been started. In order to function properly, the injectors must be recoded. The warranty will only apply to the replacement of the Spare part, no refund will be made. Article 5: Exemption from Surplus Autos Liability All Spare Parts are sold tested and cleaned.

Surplus Autos will be relieved of any liability if the defectiveness comes from: - Directly from a defect or mismatch of another part or the vehicle. From the use of the part outside the intended purpose by the manufacturer. From a modification or adaptation of the part or any other part of the vehicle not authorized or not provided by the manufacturer.

From abnormal use or failure to observe the maintenance recommendations of the vehicle or accidental damage. Article 6: Distance Selling and Withdrawal Period The Buyer has a withdrawal period of 30 business days from the delivery. The return costs are fully the responsibility of the Buyer. Article 7: Return of Parts - Non-Conformity - Buyer Verification In the case of the Buyer's error regarding the reference, the return costs and sending of a new part are the Buyer's responsibility.

If the error comes from Surplus Autos, the costs are at their expense. Any part not returned within 30 business days will not be taken back or exchanged. No credit note will be issued and no claim will be granted without presentation of the invoice. In the case of a credit note, its validity is limited to 6 months from the date of issue. The Spare Parts, even if shipped carriage-free, travel at the risk and peril of the recipient customer.

Upon receipt of the Spare Parts, the Buyer must check with the delivery person that the Spare Parts have not been damaged during transport. If the Buyer notices any damage, they must note it on the delivery note and refuse delivery. Otherwise, the Buyer will not be able to make any claims against Surplus Autos regarding the possible defectiveness of the Spare Parts. No discount will be applied in case of early payment. The Spare Parts remain the property of Surplus Autos until full payment of the invoice.

Article 9: Jurisdiction Invoices for Spare Parts are payable upon issuance unless otherwise agreed. In the event of a dispute, only the commercial court of Salon de Provence will have jurisdiction.
